Si nos das tu teléfono y marcas la casilla, aceptas recibir mensajes de texto sobre tu reporte y para agendar una conversación; el consentimiento no es condición para recibir un reporte ni para comprar un servicio, puedes responder STOP para cancelar o HELP para ayuda, y pueden aplicar tarifas de mensajes y datos. Si contratas un plan, también aplica el Acuerdo de Servicio, que prevalece si hay conflicto. El sitio y el reporte se ofrecen tal cual, sin garantías, y nuestra responsabilidad total contigo por el sitio y el reporte gratis no pasa de cien dólares ($100). Rige la ley de Nueva Jersey: antes de presentar un reclamo nos das 30 días para resolverlo, y las disputas van a los tribunales del condado de Bergen, con renuncia al juicio con jurado en lo que la ley permita y reclamos de forma individual. 1. Acceptance

These Terms of Service ("Terms") are an agreement between you and Shelf & Suites LLC, a New Jersey limited liability company ("Shelf & Suites", "we", "us"). You accept them by using shelfandsuites.com, by running a Visibility Report, by submitting your contact details, or by checking a box that refers to them. If you do not agree, do not use the site. Paying clients are also bound by the Client Service Agreement, which controls if it conflicts with these Terms. Our Privacy Policy explains how we handle information and is part of these Terms.

2. Who may use the site

You must be at least 18 and using the site for a business purpose: you own or manage a restaurant or another local business, you are evaluating our services, or you are an authorized representative of such a business. If you accept these Terms on behalf of a business, you confirm you have authority to bind it.

3. The free Visibility Report

The Visibility Report is a free, automated estimate of how a restaurant or other local business appears in Google local search, in the answers of AI assistants, on its own website, in business directories, and on social media, built from publicly available information and from the answers AI assistants give to general questions at the moment the report runs.

It is an estimate, not a measurement of your sales. The "estimated lost sales" figure, shown only on a restaurant's report, is calculated from published click-share curves, consumer-research percentages, typical local search volumes for a cuisine, and a default average ticket for that cuisine. Every input is shown on the report. Actual results differ by business.
It is a snapshot. Google results and AI answers change constantly and vary by the searcher's location and history. A report describes what we observed when we ran it, from the location of the business.
A failed check is shown as failed, never as a bad score. When an outside service does not respond, the report says so.
It is not professional advice. It is not legal, financial, tax, or marketing advice tailored to you, and nothing in it guarantees any ranking, placement, mention, or revenue.
You may run a report on any business, including a competitor, because every input is public. You may not use reports to harass, defame, or interfere with another business, and we may limit, delay, or refuse reports at our discretion, including by rate limits.
Reports are private to the person who ran them and to our team. You may share your own report. We do not publish reports.

4. Acceptable use

You agree not to: access the site or its API by automated means other than a normal browser, or scrape, copy, or resell reports or report data; attempt to bypass rate limits, consent checks, or security; upload or submit anything unlawful, infringing, or that you do not have the right to share; misrepresent who you are or which business you represent; or use the site in a way that harms it or other users. We may suspend or block access for violations.

5. Text message terms

When you provide a mobile number and check the box consenting to texts, you agree to receive text messages from Shelf & Suites about the report you ran, scheduling a conversation, and, if you become a client, service updates. Consent is not a condition of receiving a report or of purchasing any service. Message frequency varies; expect no more than four messages per month unless you are actively working with us. Message and data rates may apply. Reply STOP to cancel at any time; you will receive one confirmation message. Reply HELP for help or email info@shelfandsuites.com. Carriers are not liable for delayed or undelivered messages.

6. Our content and your content

The site, the report format, scoring methods, prompts, software, text, design, and trademarks are owned by Shelf & Suites or its licensors (including the EC Presence platform operated by EricSupply LLC). You may use your own report for your own business purposes and share it as you like, with attribution kept intact. You may not reproduce the site or report format to offer a competing service.

Anything you submit to us (a message, a photo, a correction) remains yours. You give us a non-exclusive license to use it to provide and improve our services and to respond to you.

7. Third-party services

Reports draw on Google, Yelp, Meta, Anthropic, OpenAI, Perplexity, and other services, each under its own terms. We are not responsible for their accuracy, availability, or changes. Links to other websites are provided for convenience and do not mean we endorse them.

8. Disclaimers

THE SITE AND THE FREE REPORT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY REPORT IS COMPLETE OR CURRENT. SOME STATES DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THIS MAY NOT APPLY TO YOU.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SHELF & SUITES, ITS MEMBERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM THE SITE OR THE FREE REPORT. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM RELATING TO THE SITE OR THE FREE REPORT WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). LIABILITY TO PAYING CLIENTS IS GOVERNED BY THE CLIENT SERVICE AGREEMENT.

10. Indemnity

You will defend and indemnify Shelf & Suites and its service providers against claims, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your misuse of a report, or your violation of another person's rights.

11. Governing law and disputes

These Terms are governed by the laws of the State of New Jersey without regard to conflict-of-law rules. Before filing any claim, you agree to contact us at info@shelfandsuites.com and give us 30 days to resolve it informally. Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Bergen County, New Jersey, and you consent to their jurisdiction. Each party waives any right to a jury trial to the extent permitted by law. Claims must be brought individually, not as a class.

12. Changes

We may update these Terms. The version and effective date at the top change when we do, and we will notify anyone who has given us contact details before a material change takes effect. Using the site after the effective date means you accept the new Terms.
